Form 990 Challenges (the Good, the Bad, and the Ugly) 

Preparers need be aware of changes in the current climate by which the Form 990 is used by readers to “issue-spot.” This session will review the regulator’s focus on disclosures made on the J-L-O side (not the dessert, the Schedules!) and build off of that to highlight common mistakes preparers need be aware of: those that taxpayers make in completing preparers’ organizers, and those that preparers make in applying the Form’s instructions.  

Learning Objectives

  • Understanding the common errors in reporting managers’ compensation on Part VII overall
  • Learning how to poke at taxpayer’s “governance” in favor of accurate and appropriate Form 990 Part VI and related O reporting
  • Appreciating the lack of “wiggle room”, and understanding Schedule L’s mandates as to who is an ‘interested person’ and what comprises direct or indirect transactions
  • Clarifying where the Schedule L instructions and the Schedule R instructions do and do not overlap

Eve Rose Borenstein, LLC

Eve is a prolific speaker and legal advisor serving the exempt organization (EO) sector. For 30+ years, she has advised EOs on tax-exemption qualification, tax planning and non-federal tax compliance (state law mandates, federal grant obligations, etc.). All told, she has represented ~1,100 EOs before the IRS on audit examinations, ruling requests and status issues! Eve works with numerous professional committees to bring the concerns of the sector before those who regulate EOs, and authors/instructs courses on EO topics, including nationally-recognized courses on mastering the Form 990.

Eve operated her own firm (lastly known as BAM Law Office) for 30 years through April 2019 and thereafter joined Harmon, Curran, Spielberg + Eisenberg, LLP (www.harmoncurran.com), a nationally-recognized Washington, DC firm that works almost exclusively with nonprofit organizations, as [italics here:] Of Counsel. In addition to her law practice, Eve has operated her own educational and teaching consultancy, Eve Rose Borenstein, LLC (www.taxexemptlaw.org), since 2004.
